Terms of service

These terms apply to auction sales, fixed-price/direct sales, and services.

(1) Acceptance of terms

By submitting a bid, making a direct purchase, or purchasing a service, the customer acknowledges their acceptance of these terms and conditions and agrees to be legally bound by them.

(2) Auction bids and direct sales

Auctions: The winner of a lot will be the highest bidder. In the case of two identical conflicting bids, the earlier bid received will be considered the winning bid. Bids can be submitted through our timed auction platform, NumisBids, or via email.Direct Sales: Direct e-commerce purchases are concluded on a first-come, first-served basis upon successful checkout and payment confirmation.

(3) Gallery rights and discretion

Nuqud Gallery reserves the right, at its sole discretion and without providing a reason, to cancel a bid, withdraw any item/lot from an auction or direct sale, or deny access to any customer.

Nuqud Gallery reserves the right to settle any complaints, disputes, or misunderstandings arising from auctions, direct sales, or services in the manner it deems best. All decisions made by Nuqud Gallery are final.

(4) Buyer's premium

For auction sales only, a buyer’s premium of twenty percent (20%) (with a minimum of $4 USD) will be added to the hammer price of each lot won. This buyer's premium does not apply to direct e-commerce sales or standard services.

(5) Identification and verification

All customers must, if requested by Nuqud Gallery, provide valid proof of identification, address, and/or business references (including references from other auction houses for auction registration).

(6) Description and guarantees

Accuracy: Item descriptions (including weight, diameter, grade, and other details) are provided as a guide and do not constitute a guarantee. Nuqud Gallery attempts to be as accurate as possible, but the customer is solely responsible for examining item photos and verifying descriptions prior to bidding or purchasing.

Authenticity: Items sold by Nuqud Gallery are guaranteed genuine unless explicitly described as a "reproduction" or stated otherwise.

Third-Party Grading: Items certified by third-party grading services (e.g., NGC, PCGS, ANACS) are the sole responsibility of those respective companies. Nuqud Gallery accepts no liability for claims regarding the grade or authenticity of third-party certified items.

(7) Return and refund policy

Finality of Sale: All sales, whether via auction, direct sale, or service delivery, are final. Refunds are not accepted for any reason except as outlined below.

Authenticity Claims: A refund will only be considered if an item is proven to be non-genuine (excluding items explicitly sold as "reproductions" or graded by third-party grading companies) or if the item delivered does not match the provided sale photos.

Claim Process: To initiate an authenticity claim, the Buyer must submit a written request within two (2) weeks of the delivery date. Nuqud Gallery reserves the right to select or approve the expert, otherwise third-party grading companies hold a valid opinion.

Returns: If a claim is approved, the customer is responsible for safely returning the item to Nuqud Gallery in its original, unaltered condition. A full refund of the purchase price will be issued, excluding shipping and handling costs.

(8) Limitation of liability and agency

Nuqud Gallery often acts as an agent between third-party sellers and buyers. Nuqud Gallery shall not be held responsible for any default by either party, nor for any actions, claims, damages, or losses arising in connection with any item, sale, or service provided.

(9) Payment terms

Due Date: Invoices for auctions, direct sales, or services are due immediately upon generation. For auction items, if payment is not received within 14 days of the auction's conclusion, extra storage fees will apply.

Methods: Payment can be made via Stripe (card payment), PayPal, or bank transfer. Nuqud Gallery reserves the right to deny a specific payment method and require payment via an alternative method.

Stripe and PayPal Fees: For all payments for auction purchases made via Stripe or PayPal, an additional processing fee of four and one-half percent (4.5%) will be added to the total invoice amount.

Net Payments: The customer must ensure that Nuqud Gallery receives the full, net invoice amount. Any bank transfer fees, intermediary fees, or transaction costs must be covered entirely by the Customer.

Currencies: Stripe transactions are processed in USD or AED. PayPal transactions are processed exclusively in USD. Bank transfers are accepted in either USD or AED.

(10) Shipping and delivery

Shipping Only: Items will be shipped by Nuqud Gallery only after full payment has cleared. Local pickup is not available.

Methods: Shipments are handled via FedEx International Priority or other express couriers. Other shipping methods may be determined and approved on a case-by-case basis. Nuqud Gallery reserves the right to determine final shipping and handling costs on invoices.

Customs and Duties: Any customs duties, taxes, clearances, or import issues arising in the destination country are the sole responsibility of the customer/receiver.

Risk of Loss: Risk of loss passes to the Buyer upon transfer of the package to the shipping carrier. Nuqud Gallery is not responsible for shipments lost, damaged, or delayed in transit, or held by customs/authorities. Buyers are not entitled to a refund for items lost or delayed in transit. Nuqud Gallery only recommends shipping via express couriers (for example, FedEx International Priority) to avoid loss of shipment.

Returned Shipments: If shipments are returned to the sender, return fees will be charged on the buyer and new shipping fees will be charged. If charges are not made and the transaction is cancelled, refund for the transaction will be issued, minus the initial and return shipping costs and all handling costs related to the initial shipping and the return shipping.
